The Economic and Finance Crimes Commission (EFCC) filed an application of an order to defreeze the bank account of Governor Ayodele Fayose which was dismissed by the Federal High Court in Ado-Ekiti on Tuesday.
Last year, on December 12, 2016, an application for a stay of execution was applied the EFCC and further rejected by Justice Taiwo in a ruling on Tuesday on the basis that the application presented “lacked merit”.
This application was as result of an opposing judgement EFCC got in a case brought against it by the Governor of Ekiti State, Mr Ayodele Fayose when the agency froze his account with Zenith Bank Plc.
Justice Taiwo dismissing the application said that the allegation filed against Governor fayose to stay the execution of the judgement was centered in bad faith and had no evidence of fact that an appeal has been entered by the commission. He added that once a judgement has been passed, you can not stay the execution again.
According to the justice, there was no real facts developed in the affidavit for the court to judicially pronounce the judgement already passed in the court.
Further more, he also reportedly stated that the application presented by the EFCC was in breach of Section 308 of the Niigerian constitution and henceforth reject the application tendered.
A ban placed on Governor Fayose’s account at the Zenith Bank was lifted by Justice Taiwo on December 13, 2016.
